Auditors face suits over Chinese blowups in US

Investors who have suffered a drubbing from accounting scandals at U.S.-listed Chinese companies are starting to sue the auditors who blessed their financial statements, but it will be tough for them to win in American courts.

Shareholders already have sued a string of China-based, U.S.-listed companies for fraud, saying they lost money when stocks tanked after financial scandals emerged. They contend companies invented sham businesses, inflated revenue or gave vastly different information to U.S. and Chinese regulators.

The episodes have embarrassed auditing firms, raising questions about whether they have done enough to confirm basic numbers such as cash balances on a company's books. Plaintiffs would face difficulty in collecting on any judgments against entities which have most of their operations in China and their often have legal homes in the Cayman Islands.

SEC scrambled to warn of the risks surrounding Chinese companies that have listed in the United States through reverse mergers, though critics said the intervention was too little, too late. If the SEC, which has subpoena power and can force companies and auditors to cooperate in investigations, sues more auditors or companies, investors could benefit.

Is everyone as honest as they should be? Integrity is the key word in businesses.. irony is whether people who are doing business believe in that or is it  just the S with 2 vertical lines?

you meant the accountants too. If any of them sue us for the vent of anger over their qualification. Let's stand up for Sharejuction and sue them back for incompentancy for letting us know their limitation.

Hey, the american guys set up a company in China just to dig the dirt of those rotten companies. Why the accountancy couldn't, to protect their client and boss relationship lah.

Can....of course you can........you have a good chance of winning too.  BUT, you are not going to get even a cents as most companies are offshore.

Beware of China investment risks

The Wall Street Journal quoted Martin Wheatley, former chief executive of the city's Securities and Futures Commission (SFC), as saying that investors could get burned if they rush into Chinese firms without putting their books under a microscope.

Worries about the accuracy of Chinese firms' books have long dogged the country and Wheatley's comments come amid heightened scrutiny of some Chinese companies, particularly those with foreign listings.


The US Securities and Exchange Commission is probing accounting issues at several Chinese companies that trade on US stock exchanges, with some Chinese companies having seen their shares suspended over allegations of accounting irregularities and other improprieties.
