Most of these China-based bosses do not own assets such as houses  here. This makes it almost impossible for an investor to get any form of redress by suing them in the event of a financial misdeed. There is also the problem of how to deal with listed firms incorporated in foreign jurisdictions such as Bermuda, where the Companies Act does not apply. China waste-water treatment firm Bio-Treat Technology provided a glimpse of some of the cross-border problems. Two years ago, former chairman Wing Hak Man came here alleging that his shares had been fraudulently transferred out of his name. But the High Court told him last month that it was not appropriate for him to start proceedings against Bio-Treat here as its operations are abroad and the parties he is suing are non-Singaporeans. x 0   x 0  Alert Admin	Business Times - 06 Jun 2011 Guangzhao independent auditors flag going concern risks Firm has not harvested nor sold any polar or pine timber as at June 3 By TEH SHI NING GUANGZHAO Industrial Forest Biotechnology's independent auditors have flagged two risks to the group's status as a going concern: negotiations with Liberty Harbour over US$3.45 million worth of redeemable notes as well as the success of various strategies to improve its financial position. Moore Stephens LLP yesterday issued a qualified opinion on the basis of how the group classified certain biological assets on its balance sheet for the year ended Dec 31, 2010. Guangzhao classified 142 billion yuan (S$26.9 billion) worth of poplar and pine forestry assets, which it expects to harvest or sell in the 12 months from the balance sheet date, as current assets. However, Moore Stephens points out that this is based on harvesting or sale contracts in negotiation as well as future harvesting or sales that the group expects to achieve within the 12 months. What eventually happens could differ from what the management plans, and as at June 3, the group had not harvested nor sold any polar or pine timber, the report said. The auditors added that failure of the management's harvesting/sale plans could affect Guangzhao's operating performance, financial position and cash flows for the following 12 months. Also raised was an 'emphasis of matter', drawing attention to the fact that Guangzhao's current liabilities exceeded current assets by 23.5 million yuan and 59.2 million yuan at the company and group levels respectively, for the full year ended Dec 31, 2010. Guangzhao is still in negotiations over a final settlement with Liberty Harbour, which has not, so far, demanded the immediate redemption of a remaining US$3.45 million in new notes plus interest due, as at Dec 31. These circumstances amount to a 'material uncertainty that may cast a significant doubt on the ability of the company and of the group to continue as going concerns', Moore Stephens said. Guangzhao's status as a going concern also depends on the success of strategies now being pursued, which include the harvesting/sale plans for its biological assets, obtaining alternative sources of finance, and the proposed diversification of the group's businesses to draw new sources of revenue and positive cash flow, the report said. Guangzhao's shares closed at 3.5 cents on Friday.

By the investment style that hulumas do, that she like to keep buying and buying when px drop on s-cheat, i think she lost like siao liao. 80%+ of the S-chip drop like shit till become very cheap liao, so not matter how hulumas whack and whack on those cheap cheap S-cheat anywhere, i think most of her account is in deep red now. No wonder she keep saying how good S-cheat is, she want others idiot to buy up and then sell away when got chance. Those who dont believe can go screen all china S-chip, almost 80% is at a downtrend or lowest bottom px! Only those good and strong S-chip is at a stronger support px, those S-chip i had no comment cause still got some trust in them. Only cheapo S-cheat that lost trust and value is too dangerous to touch.
